Municipal Election Notice – 2025 By-Election April 12, 2025

A By-Election to elect one (1) person to the office of Councillor will be held on Saturday, April 12, 2025. 

Are you eligible to vote? Is your name on the list of registered electors? If you are not sure you can find out by calling 250-746-3131 or by visiting the Municipal Hall, 7030 Trans-Canada Highway, Duncan, BC. The office is open from Monday to Friday from 8:30 a.m. to 4:00 p.m. excluding statutory holidays. 

As per the Election and Assent Voting Bylaw No. 3837, the Provincial Voters List prepared under the Elections Act shall become the register of resident electors on the 52nd day prior to general voting day (Wednesday, February 19, 2025).

ADVANCE NON-RESIDENT PROPERTY ELECTOR REGISTRATION

The close of advance registration for non-resident property electors is at 4:00 p.m. on Tuesday, February 18, 2025 

Advance non-resident property elector registrations will be accepted at the North Cowichan Municipal Hall until 4:00 p.m. on. Tuesday, February 18, 2025. Non-resident property elector registrations will not be accepted during the period from Wednesday, February 19, 2025 to Sunday, April 13, 2025, but will be accepted on voting days.

VOTING DAY REGISTRATION 

If you are qualified to vote, but your name is not on the list of registered electors, you may register to vote at the voting place immediately before you vote. Please bring two pieces of identification that provide evidence of your identity and place of residence (i.e., Driver’s Licence, BC Identification Card, BC Care Card, Social Insurance Number Card, credit card, phone or hydro bill, or property tax notice). One (1) piece of ID must contain your signature.

ELECTOR QUALIFICATIONS

You are eligible to vote as a resident elector if you meet the following qualifications:

  1. age 18 or older on general voting day; and
  2. a Canadian citizen; and
  3. a resident of British Columbia. for at least 6 months immediately before the day of registration; and
  4. a resident of the District of North Cowichan; and
  5. not disqualified under the Local Government Act or any other enactment from voting in an election or assent voting and not otherwise disqualified by law.

If you own property in the District of North Cowichan but live in another jurisdiction, you may be eligible to vote as a non-resident property elector* if you meet the following qualifications:

  1. age 18 or older on general voting day; and
  2. a Canadian citizen; and
  3. a resident of B.C. for at least 6 months immediately before the day of registration; and
  4. a registered owner of real property in the District of North Cowichan for at least 30 days immediately before the day of registration; and
  5. the only persons who are registered owners of the property, either as joint tenants or tenants in common, are individuals who are not holding the property in trust for a corporation or another trust; and
  6. not entitled to register as a resident elector, and
  7. not disqualified under the Local Government Act or any other enactment from voting in an election or assent voting and not otherwise disqualified by law.

*NOTE: If there is more than one registered owner of the property, only one of those individuals may, with the written consent of the majority of the owners, register as a non-resident property elector. Please contact the Chief Election Officer for further information. Tuesday, February 18, 2025 is the last day to withdraw consent for non-resident property elector to be effective for the 2025 by-election.

LIST OF REGISTERED ELECTORS

Beginning Tuesday, February 25, 2025 until the close of general voting for the election on Saturday, April 12, 2025, a copy of the list of registered electors will be available for public inspection at the North Cowichan Municipal Hall, 7030 Trans-Canada Highway, Duncan, BC, during regular office hours, Monday to Friday from 8:30 a.m. to 4:00 p.m. excluding statutory holidays. 

Before inspecting the list, a person must sign a statement that they will not inspect the list, make copies, or use the information included in the list, except for the purposes of Part 3 - Electors and Elections of the Local Government Act. 

REQUEST TO OMIT OR OBSCURE

An elector may request that their address or other personal information about them be omitted from or obscured on the list of registered electors. The elector must contact the Chief Election Officer or the Deputy Election Officer to make this request before Tuesday, February 18, 2025.

OBJECTION TO REGISTRATION OF AN ELECTOR

An objection to the registration of a person whose name appears on the list of registered electors may be made in accordance with the Local Government Act until 4:00 pm on Friday, March 7, 2025. An objection must be in writing and may only be made by a person entitled to be registered as an elector of the District of North Cowichan and can only be made on the basis that the person whose name appears on the list of electors has died or is not qualified to register as an elector of the District of North Cowichan.
