The Fireworks Regulation Bylaw regulates the sale, possession, and the discharge of fireworks in North Cowichan.
In North Cowichan:
- Buying and selling of fireworks is prohibited.
- You need a fireworks permit to possess or discharge fireworks.
- If your fireworks event is occurring on another person's property, you must also have their permission (and complete the applicable section on page 2 of the application form).
- You must be 18 years of age or older to apply for a fireworks permit.
- Fireworks cannot create a risk to the public or private property.
- Fireworks cannot be set off within 500 metres of property with livestock.
Definitions
Family fireworks are defined as low hazard fireworks generally used for recreation such as: fireworks showers, fountains, golden rain, lawn lights, pin wheels, Roman candles, and volcanoes.
Display fireworks are high hazard fireworks that launch and explode and are defined in Class 7, Division 2, Subdivision 2 of the federal Explosive Regulations. These fireworks include: rockets, serpents, shells, bombshells, tourbillions, maroons, large wheels, bouquets, barrages, bombardos, waterfalls, fountains, batteries, illumination, set pieces, pigeons and firecrackers.
Pyrotechnic displays are performance-type displays, generally used by the entertainment industry.
Apply for Fireworks Permit
Applications must be received at least three (3) business days before your planned fireworks event. Applications must include the appropriate fee ($10 for Family Fireworks permits; $100 for Display Fireworks permits; or $200 for Pyrotechnics permits).
Fines
Fines related to this bylaw can be up to $50,000 and/or up to six months imprisonment.
Every Fireworks Permit or Pyrotechnics Permit holder shall pay all costs and expenses of any fire protection services, materials or resources expended or incurred by the Municipality of North Cowichan as a result of a fire caused by a fireworks or pyrotechnics event. The fee shall be calculated in accordance with the Fees and Charges Bylaw. Fees for fire department response to fireworks issue are $550 per hour.
Fireworks safety and courtesy
- Talk to your neighbours and let them know you are planning a fireworks display.
- Remember that livestock and pets are often frightened by fireworks.
- Choose a safe area away from buildings, trees, and dry grass.
- Pick up and dispose spent fireworks in an appropriate way.
- Leave “duds” untouched for at least 30 minutes.
- Never hold lit fireworks in your hand.
